  • Federal Court Decision #A-475-89 - THE ATTORNEY GENERAL OF CANADA v. BARBARA, LEWIS

JUDGMENT OF THE FEDERAL COURT OF APPEAL

    Date:
    June 19, 1990

    Docket:
    A-475-89

    Umpire's Decision:
    CUB 17053

    CORAM:

    CHIEF JUSTICE
    MacGUIGAN, J.A.
    DESJARDINS, J.A.

    BETWEEN:

    THE ATTORNEY GENERAL OF CANADA,

    applicant,

    - and -

    BARBARA LEWIS,

    respondent.

    REASONS FOR JUDGMENT

    THE CHIEF JUSTICE:

We are all of the view that the findings of fact available to be made and so made by the Board of Referees and by the learned Chief Umpire should not be disturbed, and that it was open to the Chief Umpire to conclude as he did that the Respondent was entitled to receive unemployment insurance benefits during the annual non-teaching period.

Accordingly, the section 28 application should be dismissed.
