IN THE MATTER of an appeal to an Umpire by the
claimant from a decision by the Board of Referees
given at Nanaimo, B.C., on October 12, 1995
CORRESPONDING FEDERAL COURT DECISION: A-474-97
DECISION
The Honourable E.J. Houston, Q.C.
This appeal was heard at Nanaimo, B.C., on February 4, 1997.
The Board found that the claimant had not proven availability for work, pursuant to sections 14(a) and 40 of the Act.
Ms. Carbonell for the Commission referred me to Exhibit 7.2. She says that it is clear the claimant was not seeking work, as required in order to qualify for benefits. I agree.
The Board's decision is correct. There is no doubt that Mr. Carpentier is an outstanding citizen. However, he must come within the indicia set out in the two sections, supra.
The appeal is dismissed.
