IN THE MATTER of an appeal to an Umpire by the claimant from the decision of a Board of Referees given on January 16, 2007, at Longueuil, Quebec

    DECISION

    PAUL ROULEAU, Chief Umpire Designate

The claimant is appealing the decision of the Board of Referees given on January 16, 2007, on the ground of denial of natural justice. He submits that he was unable to attend before the Board of Referees because he could not get away from work that day. The Commission recommends that this case be referred back for a new hearing.

Having examined the docket, I consider that this case must indeed be given a hearing de novo before a differently constituted Board of Referees. The decision of the Board of Referees dated January 16, 2007, shall be removed from the appeal docket.
