    IN THE MATTER of an appeal to an Umpire by the claimant from the decision of a Board of Referees given on July 3, 2007 at Ste-Foy, Quebec.

    DECISION

    The claimant appeals from the decision given by the Board of Referees on July 3, 2007. The decision was sent to the claimant on July 4, 2007. The claimant's notice of appeal was received by the Commission on October 1, 2007, which was after the 60-day appeal period set out in section 116 of the Employment Insurance Act had expired.

    In the instance case, the claimant argued that he sent a first notice of appeal approximately one month before but did not receive any confirmation of its receipt. Therefore, on September 25, 2007, he sent a second notice of appeal. The Commission submitted that the claimant's explanation was credible, and I agree.

    Consequently, I authorize this appeal to be heard on its merits by an Umpire.
