    TRANSLATION

    IN THE MATTER of an appeal to an Umpire by the claimant from the decision of a Board of Referees given on September 23, 2008, at St-Jérôme, Quebec.

    DECISION

    The claimant is appealing from the decision of the Board of Referees given on September 23, 2008. The claimant's appeal was received by the Commission on December 16, 2008, after the expiry of the 60-day period stipulated in section 116 of the Employment Insurance Act.

    In this case, the claimant argues that she sent her letter of appeal to the wrong address and it was returned to her. She filed Exhibits 28-5 and 28-6 in evidence. Under the circumstances, the Commission considers the claimant to have shown a "special reason" for her delay.

    Consequently, I allow the appeal to be heard on its merits before an Umpire.
