IN THE MATTER of an appeal to an Umpire by the claimant from the decision of a Board of Referees given on July 28, 2009 at Baie-Comeau, Quebec.

The claimant appeals from the decision given by the Board of Referees on July 28, 2009 on the ground that there was a breach of natural justice. He submits that he did not receive a notice of hearing. The Commission recommends that the matter be referred back for rehearing before a differently constituted Board of Referees.
Having reviewed the docket, I find that this matter must indeed be the subject of a hearing de novo before a differently constituted Board of Referees. The Board of Referees' decision dated July 28, 2009 shall be removed from the appeal docket.
